DEFINITIONS
“Agreement” - Hicom’s contract with the Organisation, incorporating the licence agreement, costs and general terms and conditions of supply
“Users”- Any user registered with the Intrepid Service
“Content”- All text, images, documents and links contained within the Intrepid Service controlled and managed by the Organisation
“Organisation” - The Organisation to whom the Intrepid Service is provided under the Agreement
“Hicom Technology” - Hicom Technology Ltd, the provider of the Intrepid service
“Intrepid Service” - The system provided to the Organisation and the User as a hosted and maintained software service via the Internet
ACCEPTANCE OF TERMS
This statement sets out the terms and conditions for use of the Intrepid Service, which forms part of an electronic service provided by Hicom Technology to the Organisation.
Your access to, and use of, the Intrepid Service, is subject exclusively to these Terms and Conditions and by proceeding and continuing to access The Intrepid Service you agree to be legally bound by these Terms and Conditions.
Hicom Technology reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Intrepid Service shall be deemed to be your acceptance of any such change.
USE OF THE INTREPID SERVICE
You will not use the Intrepid Service for any purpose that is unlawful or prohibited by these Terms and Conditions or by the laws of the United Kingdom or any country from which the Intrepid Service is accessed.
In using the Intrepid Service you agree that:
- You will not post or publish any information or materials that are considered defamatory, obscene, indecent, threatening, abusive or unlawful in any way.
- You will not violate any applicable laws or regulations, including impersonating any person or entity for the purpose of misleading others.
- You will not upload or make available in any way files that contain a virus or other such corrupt data that may damage or impede the operation of the Intrepid Service or the property of others.
- You will not use the Intrepid Service in any manner that could damage, disable, overburden or impair the Intrepid Service or interfere with any other party’s use the Intrepid Service.
- You will not attempt to gain unauthorised access to any part of the Intrepid Service, any other accounts, systems or networks through the process of hacking or by any other means.
Hicom Technology accept no liability for the misuse of the Intrepid Service by any party.
Hicom Technology accept no liability for any consequences related to any person's misuse or inability to use the Intrepid Service. Hicom Technology do not guarantee uninterrupted access to the Intrepid Service.
SECURE ACCESS
Access to this site is provided by the Organisation via log-in credentials (email address, PIN and password).
You are responsible for maintaining the confidentiality of your log-in credentials and for all activities which take place under your account.
You agree to immediately notify Hicom Technology of any unauthorised use of your log-in credentials or any other breach of security, whether proven or suspected.
In no event will Hicom Technology be liable for any direct, indirect or consequential loss or damage whatsoever resulting from the disclosure of your log-in credentials. You may not use another person’s log-in credentials at any time.
COPYRIGHT
The Intellectual Property Rights (IPR), copyright and ownership of the Intrepid Service as a whole or in part shall remain vested with Hicom Technology at all times.
All text, images and data provided by Hicom Technology as part of the Intrepid Service are subject to copyright but may be downloaded and printed only by NHS Organisations and/or the User for personal use only to assist with the recruitment process and must not be used for commercial gain or other exploitation.
No party, including NHS Organisations and/or Users may otherwise use, copy or save text, images or data, or distribute any material from the Intrepid Service.
Hicom Technology's decision in relation to any requests for use or publication of text, images or data from the Intrepid Service is final and made at Hicom Technology’s absolute discretion.
In using the Intrepid Service you agree that you will not post or publish material or information that you do not have a right to do so under any law or under any existing contractual agreement including, but not limited to, any material that may infringe an existing copyright.
VALIDITY OF INFORMATION
Hicom Technology will attempt to ensure that all information presented within the Intrepid Service is accurate, however no guarantees are given in respect of its accuracy, completeness or adequacy.
Hicom Technology makes no guarantee that the Content will meet your requirements or that the Content is accurate, reliable or error free. Any comment or concern in respect of the Content should be addressed to the Organisation.
The Intrepid Service may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and Hicom Technology is not responsible for the content or availability of any such sites.
THE ORGANISATION
NHS Organisations who wish to make use of the Intrepid Service are required to enter into a contractual Agreement with Hicom Technology.
Hicom Technology shall not be liable to any party for any loss or damage whatsoever arising directly or indirectly in connection with this agreement, the Intrepid Service, its use, application, support or otherwise, except to the extent to which it is unlawful to exclude such liability.
The Content is the sole responsibility of the person from whom the Content originated. Hicom Technology do not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of the Content.
Hicom Technology will not be liable in any way for the Content or for any loss or damage of any kind resulting from the use of the Content transmitted via the Intrepid Service and the Organisation bear all risks associated with the use of the Content, including any reliance on its accuracy or completeness.
The Organisation shall ensure that all personnel with access to the Intrepid Service will act in accordance with these Terms and Conditions and the terms of the Agreement with Hicom Technology.
